1. Introduction
These Terms and Conditions ("Terms") govern your enrolment in and access to training courses, services, and the website (pkdtraining.com.au) provided by PKD Training Pty Ltd ("PKD Training", "we", "us", or "our").
By enrolling in a course or using our website or services, you agree to be bound by these Terms. Please read them carefully before proceeding. If you do not agree to these Terms, please do not enrol or use our services.
2. About PKD Training
PKD Training Pty Ltd provides professional development and vocational training for the resource industry, operating in Brisbane, QLD and Perth, WA. Nationally accredited courses are delivered on behalf of Tectra Australia Pty Ltd (RTO#40889).
3. Enrolment
3.1 Eligibility
By submitting an enrolment, you confirm that:
• All information provided is true, accurate, and complete
• You meet any prerequisites specified for the course
• You are legally entitled to enrol and, where applicable, authorised by your employer to do so
3.2 Enrolment confirmation
Your enrolment is confirmed only upon receipt of written confirmation from PKD Training. We reserve the right to decline any enrolment at our discretion.
3.3 Student Responsibilities
As a student, you agree to:
• Participate actively and honestly in all training and assessment activities
• Treat trainers, assessors, and fellow students with respect
• Comply with all workplace health and safety requirements during any on-site training
• Provide accurate identification and eligibility documentation when requested
• Obtain a Unique Student Identifier (USI) prior to course commencement, where required
4. Fees and Payment
4.1 Course Fees
Course fees are outlined in your enrolment documentation and course quote. All fees are quoted in Australian Dollars (AUD) and include GST where applicable.
4.2 Payment Terms
Payments are invoiced and must be made within the timeframe specified on your invoice. We accept payment via the methods stated on the invoice. Enrolment may not be finalised until payment is received or satisfactory payment arrangements are in place.
4.3 Late Payment
PKD Training reserves the right to suspend access to training materials, assessments, or the student portal if payment is not received by the due date. We may also charge reasonable late payment fees where appropriate.
5. Cancellation & Refund Policy
We understand that circumstances change. Our refund policy is designed to be fair to both students and our organisation.
5.1 Cancellation by the student
• Cancellation 10 or more business days before the course start date: Full refund of fees paid, minus a $50 administration fee.
• Cancellation 5–9 business days before the course start date: 50% refund of fees paid.
• Cancellation fewer than 5 business days before the course start date: No refund. However, you may be eligible to transfer to a future intake (see clause 5.3).
• No-show (failure to attend without prior notice): No refund.
5.2 Cancellation by PKD Training
If PKD Training cancels a course, you will receive a full refund of all fees paid, or the option to transfer to an alternative date at no additional cost. PKD Training will not be liable for any additional costs incurred by the student as a result of the cancellation.
5.3 Transfers
Students who wish to transfer to a different course date must provide at least 5 business days' notice. One transfer per enrolment is permitted at no charge, subject to availability. Subsequent transfers may incur an administration fee.
5.4 Withdrawals Mid-Course
No refund will be provided for course withdrawals after training has commenced, unless exceptional circumstances apply. Requests for refund based on exceptional circumstances must be submitted in writing to admin@pkdtraining.com.au and will be assessed on a case-by-case basis.
5.5 How to Request a Cancellation or Refund
All cancellation and refund requests must be submitted in writing to admin@pkdtraining.com.au. Refunds will be processed within 14 business days of approval.
6. Intellectual Property
All training materials, course content, assessments, handouts, and other resources provided by PKD Training remain the intellectual property of PKD Training Pty Ltd and/or its licensors. You may use these materials for your personal learning purposes only. You must not:
• Reproduce, distribute, or share course materials without written permission
• Upload or publish any course materials to any platform or third-party system
• Use course materials for commercial purposes
7. Student Portal & Online Access
Access to the PKD Training Student Portal (powered by TalentLMS) is granted upon enrolment confirmation. You are responsible for maintaining the confidentiality of your login credentials. You must not share your account with any other person. PKD Training reserves the right to suspend or revoke portal access in the event of misuse.
8. Assessment & Qualifications
Nationally accredited qualifications and Statements of Attainment are issued by Tectra Australia Pty Ltd (RTO#40889) on behalf of PKD Training, subject to successful completion of all assessment requirements. PKD Training makes no guarantee of a particular outcome and results are determined solely on the basis of your performance against the required competency standards.
If you are deemed Not Yet Competent (NYC) in any unit, you may be offered a reasonable opportunity to resubmit, as outlined in your course information. Additional assessment attempts may incur fees.
9. Complaints & Appeals
PKD Training is committed to fair and transparent handling of complaints and assessment appeals.
• To lodge a complaint or appeal, please contact us in writing at admin@pkdtraining.com.au.
• We will acknowledge your complaint within 5 business days and aim to resolve it within 20 business days.
• If you are not satisfied with our decision, you may escalate the matter to Tectra Australia Pty Ltd (RTO#40889) or the relevant state training authority.
10. Limitation of Liability
To the fullest extent permitted by law, PKD Training Pty Ltd shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your enrolment or participation in our courses or use of our website.
Our total liability to you for any claim arising out of or in connection with these Terms or your enrolment shall not exceed the total fees paid by you for the relevant course.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
11. Website Use
Your use of pkdtraining.com.au is subject to these Terms and our Privacy Policy. You agree to use the website only for lawful purposes and must not attempt to disrupt, damage, or interfere with the website or its servers. PKD Training does not warrant that the website will be uninterrupted, error-free, or free of viruses.
Our website contains links to third-party websites (including our student portal and partner websites). We are not responsible for the content or privacy practices of those websites.
12. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
13. Changes to These Terms
PKD Training may update these Terms from time to time. The current version will be published on our website at pkdtraining.com.au. Continued use of our services after changes are published constitutes your acceptance of the updated Terms.
